Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Hush application ("App") and related services provided by Axleno LLC ("we", "us", or "our"). By downloading, installing, creating an account, or using the App in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Hush, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules we publish within the App. These Terms constitute a legally binding agreement between you and Axleno LLC.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and notify you through the App. Your continued use after changes take effect means you accept the updated Terms.

2. Eligibility

You must be at least 13 years of age to use Hush. By using the App, you represent and warrant that you meet this age requirement. Users between 13 and 17 may use Hush with the consent of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf.

If we learn that a user is under 13, we will promptly terminate their account and delete their data in compliance with COPPA.

3. Account Responsibilities

You may create an account using Apple Sign-In, Google Sign-In, or other authentication methods we offer. You are responsible for:

Maintaining the security and confidentiality of your account credentials.
All activity that occurs under your account, whether or not you authorized it.
Providing accurate and up-to-date profile information.
Notifying us immediately at support@hushforall.com if you suspect unauthorized access to your account.

You may not share, transfer, or sell your account to another person. We reserve the right to suspend accounts that appear to be shared or compromised.

4. Acceptable Use Policy

Hush is designed to be a safe, respectful, and calming environment for everyone. You agree to use the App only for lawful purposes and in a manner that does not infringe upon the rights of others. Specifically, you agree not to:

Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law.
Harass, abuse, stalk, threaten, or intimidate other users.
Post, transmit, or share content that is illegal, obscene, defamatory, fraudulent, or harmful.
Impersonate any person, entity, or falsely represent your affiliation with any person or entity.
Transmit spam, chain letters, phishing attempts, or unsolicited communications.
Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the App.
Interfere with or disrupt the App's infrastructure, servers, networks, or other users' experience.
Use bots, scripts, or automated tools to access or interact with the App without our written permission.
Collect or harvest other users' personal information without their consent.
Circumvent or attempt to circumvent any content moderation, security, or access controls.

5. Zero Tolerance Ban Offenses

The following behaviors result in immediate, permanent account termination with no warnings, no appeals, and no refunds. Where required by law, we will report violations to the appropriate authorities.

Permanent Ban -- Immediate Enforcement

Child Sexual Abuse Material (CSAM): Any creation, distribution, possession, or solicitation of child sexual abuse material. This is reported immediately to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies.
Child Exploitation or Grooming: Any attempt to exploit, groom, solicit, or endanger a minor in any way.
Terrorism: Content that promotes, recruits for, glorifies, or provides material support for terrorism or violent extremism.
Racism, Hate Speech, and Discrimination: Content or conduct that promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
Harassment, Bullying, and Threats: Targeted harassment, bullying, threats of violence, intimidation, or doxxing (publishing someone's private information without consent).
Non-Consensual Intimate Imagery: Sharing, distributing, or threatening to share intimate or sexual images of any person without their explicit consent (commonly known as revenge porn).
Self-Harm and Suicide Encouragement: Content that encourages, glorifies, or provides instructions for self-harm or suicide.
Illegal Drug Trafficking: Using the App to facilitate the sale, purchase, or distribution of illegal drugs or controlled substances.
Spam, Scams, and Phishing: Engaging in spam campaigns, fraud, scams, phishing, or impersonation schemes designed to deceive users.
Malware and Hacking: Distributing malware, viruses, or other harmful code, or attempting to hack, exploit, or gain unauthorized access to the App, its infrastructure, or other users' accounts.

We cooperate fully with law enforcement investigations. Evidence of criminal activity will be preserved and reported to the relevant authorities. Banned users may not create new accounts.

6. Content Moderation

We use a combination of automated systems and human review to moderate content and maintain community safety. We reserve the right to review, moderate, restrict, or remove any user-generated content at our sole discretion. Content that violates these Terms may be removed without prior notice.

Non-zero-tolerance violations may result in warnings, temporary suspensions, or permanent bans depending on severity and frequency. Zero tolerance offenses (Section 5) result in immediate permanent bans.

7. Intellectual Property

Our Content

All content, features, functionality, design, code, graphics, audio, sounds, music, trademarks, logos, and branding in the App are owned by Axleno LLC and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.

Your Content

You retain ownership of any content you create or share through the App (such as display names, room names, or text messages). By sharing content through the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and improving the App. This license ends when you delete the content or your account.

Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us an unrestricted, perpetual, irrevocable license to use that feedback for any purpose without compensation or attribution.

8. In-App Purchases and Subscriptions

Subscription Plans

Hush offers premium features through the following subscription options:

Weekly -- auto-renewing weekly subscription.
Monthly -- auto-renewing monthly subscription.
Annual -- auto-renewing annual subscription.
Lifetime -- one-time purchase granting access for the life of the product.

Billing

All purchases are processed through Apple App Store (for iOS/macOS) or Google Play Store (for Android) using your respective account. We do not receive, process, or store your payment card details. Prices are displayed in your local currency and may vary by region.

Auto-Renewal and Cancellation

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription at any time:

Apple: Settings > Apple ID > Subscriptions
Android: Google Play Store > Subscriptions

Cancellation takes effect at the end of the current billing period. You will continue to have access until that period expires. No partial refunds are provided for unused portions of a subscription period.

Lifetime Access

A "Lifetime" purchase grants access to Hush's premium features for the lifetime of the product (i.e., for as long as Hush remains available and operational). It does not guarantee perpetual availability of the App itself.

Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly. If you have billing questions, please contact Apple Support or Google Play Support.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

The App will be uninterrupted, timely, secure, or error-free.
The results obtained from using the App will be accurate or reliable.
Any defects will be corrected.
The App will be compatible with all devices or operating systems.

Hush is a wellness and relaxation tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. It should not be used as a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your health, consult a qualified healthcare provider.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Axleno LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of (or inability to use) the App, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you exceed the greater of: (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty US dollars ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Axleno LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you share through the App.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction and venue of such courts.

Before filing any formal legal proceeding, both parties agree to attempt to resolve any dispute informally by contacting the other party. We will try to resolve your concern within 30 days.

13. App Store Terms

Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

These Terms are between you and Axleno LLC, not Apple Inc.
Apple has no obligation to furnish any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is not responsible for addressing any claims relating to the App or your use of it.
Apple is a third-party beneficiary of these Terms and may enforce them against you.

Your use of the App is also subject to the Apple Licensed Application End User License Agreement.

Google Play Store

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. In the event of any conflict between these Terms and Google Play's terms, these Terms govern your relationship with Axleno LLC.

14. Termination

By You

You may stop using the App at any time. To fully terminate your relationship with us, you may delete your account through the App's settings or by contacting us. Please cancel any active subscriptions through Apple or Google to prevent further billing.

By Us

We reserve the right to suspend or terminate your account, without prior notice, if:

You violate these Terms or engage in any zero tolerance offense (Section 5).
Your conduct is harmful, threatening, or disruptive to other users, our team, or third parties.
We are required to do so by law or legal process.
Your account appears to be compromised or used for fraudulent purposes.

Upon termination:

Your access to the App and all premium features will be revoked immediately.
You remain responsible for cancelling any active subscriptions through Apple or Google.
Your data will be handled in accordance with our Privacy Policy.
Provisions of these Terms that by their nature should survive termination (including Sections 7, 9, 10, 11, and 12) will survive.

15. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you through an in-app notification or App update. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and may request account deletion.

16. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Axleno LLC regarding the App.
Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
No Third-Party Beneficiaries: Except as expressly stated (e.g., Apple as a third-party beneficiary under Section 13), these Terms do not create any rights for third parties.
